Terms of Use

These Terms of Use ("Terms") are an agreement between you and Convergence Solutions LLC ("we," "our," or "us") for your use of the Incident Handbook Pro mobile application ("the app"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. What the app is, reference only

Incident Handbook Pro is a professional reference and productivity tool for incident management. It provides reference content, checklists, an organizational chart, and the ICS 201 and ICS 214 forms that you can fill out and export.

The app is for reference and planning support only. It is not a substitute for official training, official publications, professional judgment, or the direction of your Incident Commander or chain of command. Always verify procedures against current U.S. Coast Guard guidance and the most recent official Incident Management Handbook, and follow real-time direction during an actual incident. Do not rely on the app as your sole source of authority in an emergency.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your own professional or personal use, subject to these Terms and the rules of the App Store or Google Play. You may not copy, modify, reverse engineer, decompile, resell, sublicense, rent, or distribute the app or its content, except as allowed by law or by the applicable app store's terms.

3. In-app purchases

Browsing the reference content, checklists, and the organizational chart is free, and you can view a read-only sample of each form. Filling out your own ICS 201 or ICS 214 and exporting it as a PDF requires a one-time in-app purchase (per form, or as a bundle). These are one-time purchases, not subscriptions.

Purchases are processed and billed by Apple (App Store) or Google (Google Play) under their terms, not by us, and we do not receive your payment card details. You can restore previous purchases from the app's Settings. Refunds, billing questions, and purchase support are handled by Apple or Google under their refund policies; we do not separately process refunds.

4. Your content

Anything you enter into the app, including form drafts, attached images, checklist progress, bookmarks, and settings, is yours and is stored on your device. We do not collect or access it (see our Privacy Policy). You are responsible for the accuracy of what you enter, for backing it up, and for handling it in line with any rules that apply to your organization or to sensitive or operational information.

5. Intellectual property

The app, its software, design, and original content, including the job-aid checklists, are owned by Convergence Solutions LLC and protected by intellectual property laws. The underlying ICS forms and Incident Management Handbook content are U.S. Government works. This app is an independent product. It is not affiliated with, endorsed by, sponsored by, or officially connected to the U.S. Coast Guard, the Department of Homeland Security, or any other government agency.

6. Third-party services

The app uses Apple, Google, and RevenueCat to deliver and manage in-app purchases. Your use of those services is subject to their own terms and privacy policies. See our Privacy Policy for how purchase data is handled.

7. Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that the content is current, error-free, or suitable for any particular incident, decision, or jurisdiction.

8. Limitation of liability

To the fullest extent permitted by law, Convergence Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss or damage arising from your use of, or reliance on, the app or its content. Our total liability for any claim relating to the app will not exceed the amount you paid for the app and its in-app purchases in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Changes to the app and these Terms

We may update, change, or discontinue the app or these Terms at any time. If we change these Terms, we will update the date above and post the revised version on this page. If you keep using the app after a change takes effect, you accept the updated Terms.

10. Termination

You may stop using the app at any time by uninstalling it. We may suspend or end your license if you breach these Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
